Job Purpose
The purpose of the Senior Contracts Specialist is to take responsibility for all aspects of the procurement, tender and contract process from creation to evaluation and award for a multi-billion dirham port expansion project. In addition to this the position is responsible for contractor risk management, contract compliance monitoring and support during contract execution. These activities include, negotiation with executives of key suppliers to achieve value for money and ensure they are competent to carry out the work.
Job Responsibilities
1. Actively follow and promote the ADT Safety and Security policies and ensure that fellow employees and visitors are doing the same. These policies are to be always followed within the port environment so as to ensure a safe and secure workplace for all.
2. The position will be expected to directly lead the development of complex and high value tenders and drive the development and management of all other tenders and supplier quotations.
3. Ensure strict compliance to company procurement policies, including the creation, maintenance, and approval of clauses, variables, deliverables, and contract templates.
4. The position will be responsible for certifying payment milestones to ensure suppliers are paid when all contractual obligations for the milestones have been achieved
5. Analyze and strive to maintain up-to-date knowledge of market trends, pricing, availability, and capacity, technology and supplier capability relative to the product or parts assigned.
6. Develop and manage effective strategies & best practices to improve overall performance of the Procurement & Contracts function within the project team.
7. Prepare the tender strategy, tender time scale and the tender documents to get best possible bids by reducing risk and protecting the interest of the Organization.
8. Identify and evaluate various risks that can occur in case of a Contract is awarded and negotiate with the bidder to mitigate the risk to ADT.
9. Oversee the timeliness of procurement & Contracts flows. Identify and resolve any issues and seek continuous improvement.
10. Negotiate Major Contracts/tenders to get the best values for the organization.
11. Verify purchase orders/Contracts; determines and negotiates prices, delivery and credit terms; buys according to established company policies and procedures;
12. Monitor vendor/Contractor performance during contract execution to ensure compliance with all contractual terms and conditions
13. Provide business and ongoing commercial advice to the project team members and various departments as needed.
14. Conduct an in-depth analysis of all bids received in response to each Tender, Proposal and Quotation to identify the response that best meets the needs of the project and is consistent with the terms and conditions of ADT's procurement policy. Prepare recommendation for award. Provide supplier debriefing sessions, when requested, with unsuccessful respondents.
15. Liaise and consult with Legal Counsel for legal opinions and in order to establish contract standards and reach agreements on key contractual and legal issues
16. Represent tender evaluation committee for bid opening and evaluation and advise the committee on commercial matters
17. Responsible for the timely preparation and administration of all contractual documentation related to contracts and in accordance with the project and company procedures
18. Follows up on contracts, including preparing amendments, cancellation, extensions and claims, obtaining management's approval and keeping current files for all contracts
19. Responsible for verifying that all required internal/external approvals are obtained before any external commitment is signed, and ensure all warranties, performance bonds and insurance policies are obtained from contractors
20. Develop Simplified Financial models to serve decision making during negotiations
Qualifications and Experiences
Bachelor degree in Engineering.
Certified Contracts Manager from an International accredited body like CIPS/ IPSCMI etc.
Formal qualification Procurement Management/ Supply Chain Management from an International accredited body like CIPS/ITC/WTO etc.
7 years experience in a executing procurement using FIDIC based contracts, preferable in large industrial projects. Managing the tendering of large procurement contracts in excess of 100 Million USD.
Experience in Procurement & Contracts of large scale corporations
Excellent understanding of Procurement and contract principles
Excellent understanding of contract dispute resolution
